Last month, Amber Road’s Global WCO-image-150x150-1.jpgTrade Academy broadcasted a webinar WCO 2017 HS Changes: Is your Company Prepared? Our presenters, Kristine Bols, Director of Global Trade Content at Amber Road and Suzanne Richer, Director of Amber Road’s Trade Advisory Practice, received several questions throughout the webinar. Unfortunately they did not have time to address them all during the live broadcast. We have compiled their answers into a Q&A document - here is a preview:

Will these changes also affect Schedule B numbers?
Yes, this will also affect the schedule B numbers. They will be updated or changed according to the 2017 amendments.

Can you confirm HS 2017 changes are binding in January 2017? Was it just the complementary amendments that are not binding until 2018, but can be applied Jan 2017?
The 2017 amendment will be effective on January 1, 2017. Member states, however, are not obligated to implement these changes, so technically, the amendment is not binding. As has happened in the past, some countries may decide not to implement a WCO change, while others may do so but will publish their new tariff on a later date (e.g. Japan typically publishes the tariff in April). As for the complimentary amendment, the effective date is January 1, 2018, but countries may opt to implement the changes as of January 1, 2017.

Ultimately, are these WCO changes only guidance for members, as each member state decides, how, when, etc. to implement?

That is correct. The amendments are not binding. As has happened in the past, some countries may decide not to implement a WCO change, while others may do so but will publish their new tariff on a later date (e.g. Japan typically publishes the tariff in April).

When will PGA applicability be determined for new/revised HS Codes?
We expect the PGA applicability to be updated with the new 2017 codes at the same time that the new 2017 tariff is published. Please note that this will be only for PGAs that are already in production.
